So sick of this. Can't wait to go back to the wonderful Hoosier state where folks are sane. I have posted before about being shut down by police, even when cleaning in industrial/commercial areas at night. Today, me and a buddy went to clean about 200 feet of hallway at a retirement home I take care of. We started at 5:30, figured we would finish by about 7:30 or so. No big deal. Right?

Wrong.

Apparently some neighbors that must be probably 400 ft or further away complained. I was like "Ummm...its 6 pm. Is there a time that this is allowed? Because I thought this is well within the hours that I can make noise." The cop flat out said "If we get a complaint, you have to stop. If we get another complaint, you are going to jail". So I said "ok let me turn my speed on low, and see if that works for you guys". I go out to my butler, set the speed on idle. You can BARELY hear it from 50 ft away when its on idle speed, let alone from across the street and parking lot. He tells me "Nope. Must be completely silent. If you start it up again, I have to take someone to jail" Then they left.

Insanity.

No we've been kicked out of many places for working after 5. Its mostly retirement communities or hoa. They may have their own rules. Theyll bit just for your truck being there after 5.

I rented a cimex to do a really far hallway there 2 weeks ago. Maybe I just need to learn it better, but I found it very frustrating. It is pretty soiled and I found it very difficult to get to the edges of the doorways with the cimex, It also dried a little weird in some areas, kind of crunchy. But I had never used it before so maybe need practice. The other thing is, I clean this dining room every 2 months or so, at the same retirement home, and I START at 7:30 pm there and finish at 9:30. So I have no idea how I am going to clean that now. May have to do half one morning kind of early and then half another morning. I doubt the dining room can be VLM'd

Yeah, all of the HOAs here have a 5 pm rule, which I am aware of. But this is not in an HOA, this was just police telling me that in general I can't make noise if anyone complains.

Lol i would of said cite me and ill see you in court. 6 pm fk that. Someone gets upset and if they call its now your problem? Pfff here its 8am-10pm. They may come try and chase you off. Because every time they get called they have to respond. Oh freakin well we have to make a living too. If that's your job and you have to put down the coffee or your phone and respond? Then so be it. Thats the job you chose. My job is to complete this contract.

Id have prob went to jail, i would have told the cop do what you have to do brother I have bail money and a rockstar attorney that literally lives to sue people for shit like this.

Honestly I kind of wanted to. Different cops here say different things about the noise. And the fact that he brought up being arrested while I was being super respectful and in the middle of working just felt like some straight bullshit to me.

Find out what the law is for noise and what the cutoff time is for the area you service. Then keep a copy of it with you in the van binder. Happens again, pull it out and show the idiot cop the RSA rule and then move on with your job. If he arrest you, do what SRD said and sue the city/town for false arrest and harassment.

By the way, Butler is one of the least noisy machines out there.

Just sayin

Would they rather you do it at 4am instead of 6pm? I do not understand how 6pm would be an issue for noise. I mean a lawn mower is probably louder, are people not suppose to mow their own lawn now.

When something like this happens, DEMAND that they show you which law you are violating. Cops generally want to take the path of least resisistance so if they make you stop, even if you are breaking no laws, they won't have to respond to any more complaints about it. Many law enforcement officers also either flat out lie, or are misinformed about the many laws. Do your own research, but always have them PROVE whatever law you are supposedly violating. There's no reason to spend hard earned money to buy or rent equipment to do the same thing you are already doing just to please a dbag cop or neighbor.

What city were you in? I will look up the municipal code and then next time the police show up just have a copy of the law. Show it to them and tell them they can come and check after 10:00 P.M. to see if you are still there.

Just because he has a badge, gun and handcuffs doesn't mean a cop gets to make stuff up as he goes. He is required to enforce law, not someone's whim! Also, cop can't enforce HOA rules. It sounds like you were outside of any HOA but within earshot of it.

Noise only applies to vehicles using sound amplification equipment. Your equipment has noise cancelling equipment (silencer(s)) on the blower. Tell the cop to show you the code you are violating. He will back down.

This link is the complete guide to noise enforcement for Maui.

It appears that the 6 P.M. rule only applies to leaf blowing within 100 feet of a residence.

Perhaps I'm wrong (it does happen), but being that you're contracted by the property management... I assume anyway... isn't it their call whether or not you can clean at 6... midnight... 5am... whenever? My go-to any time that I've had a resident mess with me has always been "talk to management, I'm just doing my job". Admittedly, I've never had to deal with a police officer, but my response to one would pretty much be the same thing. /shrug

Seriously though, isn't this the same guy that has a bunch of rugs, and wants to overpay with a cashier's check? Sure sounds like him...
