How to handle a bounced check.

This is for California cleaners please as this is a California situation and each state's laws are different.

I got some biatch from hell who when she paid me gave me a post dated check. I waited till after the date on the check and took it to my bank, same bank as hers. They told me there was no money in the account. I did this three or four times over the last 6 weeks. Finally got fed up and just deposited it into my account and it bounced and I got hit with a small fee. v

So I call the lady today and she gives me all kinds of crap. So I told her either pay up or I'll take her to court. She hung up on me.

So my question is how to I get my money? :)
I know this is simple, but I dont accept checks from anyone. Cash or charge unless it is my property manager..

I've only had maybe 3-4 bounced cheques in 22 years of business and I take loads of cheques. I would keep trying to have it clear at her bank ( you said you bank there too).
If she hasn't closed her account and it's active as in making a deposit periodically wait for funds to come in and then have the cheque certified and redeposited into your account. You may need to eat the $17 NSF charge and the certification charge.
No , up here the cops look at this as a civil matter. Pretty hard to have them pursue fraud charges if it's under 5k.
Last resort is collection agency. Those fukers are relentless and will hound that bit$h until she pays. You may only get 50 cents on the dollar , but better than a kick in the head.
Obviously you tried going about nicely, now the gloves are off!
I understand Bravo it's a principal thing now.

Last couple checks I had like that where the customer would not make good on them I just held them.
Here a check is good for 6 months from the date on it.
Checked both accounts periodically and there was money in them months later.
I figure the customer thought we gave up on collecting.
Probably pi$$ed the customer off royally but oh well.

This turned out great. Went and filled out the papers to prosecute her, within a few days the police payed her a visit and gave her a chance to pay which she said no. They arrested her took her in, she got stripped searched and put in a holding cell. She had to post bond to get out.

Within a few hours she was at our shop with the money apologizing, and how embarrassing this was trying to get us to drop the charges. She still had to go to court which was going to sting a little more.

Its not worth the effort but you can take her to small claims Court.
Its very easy Johnny.

For checks, use a service called telecheck.
Immediately tells you if the check is valid.
Also, an ID number , drivers license is required so you check the name and write down the license number.

Why did she refuse to pay when the police talked to her?
