How to handle a bounced check.

This is for California cleaners please as this is a California situation and each state's laws are different.

I got some biatch from hell who when she paid me gave me a post dated check. I waited till after the date on the check and took it to my bank, same bank as hers. They told me there was no money in the account. I did this three or four times over the last 6 weeks. Finally got fed up and just deposited it into my account and it bounced and I got hit with a small fee. v

So I call the lady today and she gives me all kinds of crap. So I told her either pay up or I'll take her to court. She hung up on me.

So my question is how to I get my money? :)

Why did you deposit the check if the teller told you there was no money in the account?


Because I need to prove the check is no good before I go after her for passing a bad check.

You need to take anything you have from your bank to show the check was bad. Include fees etc. make notes of date time / who you spoke to. Go to your county attorney and file theft by deception charges. I know you are in California but this should be the right start.

It would fly here. Subpoena would be issued to her you would have a court date. She would have to pay court costs and reimburse you the fees plus your cost of service. Would be an easy one with your proof from the bank.

I am not in Cali Johnny, but generally what we do with renters is, if we have a feeling that their check will not clear or it is returned NSF, we will call there bank, give them name and account number at the bottom of the check and they will tell you if the person has the funds to cover the check at that time or not. If they do, get to their bank ASAP and cash the check.

I would call and discuss a payment plan. Be nice it works wonders. If not take her to court. What works for me is I threaten to turn it over to a collection agency. They don't want it hurting their credit.

I just kept texting and calling my customer until I finally got a hold of her and very nicely told her that I really did not want to take her to court and ruin her credit. If she has any credit at all, maybe this will convince her to pay you. By the way mine ended up paying me cash, apologized and gave me a big hug. Go figure.

This has happened to me before. I just kept texting and calling my customer until I finally got a hold of her and very nicely told her that I really did not want to take her to court and ruin her credit. If she has any credit at all, maybe this will convince her to pay you. By the way mine ended up paying me cash, apologized and gave me a big hug. Go figure.


This lady was a customer from hell right out of the gate. No reasoning or talking with her. Just want to know how to go about it through legal channels i all.
