Thread: issues with my company name

on friday i got a call from the CEO of West Coast maintenance Inc. he asked me what kind a cleaning i do, and i told him that we clean houses, offices, and carpet cleaning, and he said so you only do residential and said yes. and he asked when i registered my company and i said 2008, then he said we have the same name, i;ll talk tomy attorney about this. and i told him ok. now do you guys think that they are going to make me change my company name, because he registered his on 2004. i was checking in the Angeles county recorder all the names and there are other similarnames i even found a west coast maintenance service, and mine is west coast maintenance services, is wierd why they let me registered this name. thanks for your advices

If you have to change it, change it to JC's West Coast Maintenance Services

Okay were do I start. If you are both just working as entities, there is no problem as long as your working in different counties and you just have to send a copy of your State Business Papers to an approved paper in each county for two weeks, if no one objects its yours. If they are a franchise or incorporated then you have a problem. Each State is different, but as a rule of thumb, an entity or a DBA only controls the name in the counties they are doing business.

I would go to where you registered and find out why this happen... They must of not checked good.. I would think he had the name first and registered it before you he has the rights to it... I would be upset with the person who let you have the name and not did the check correctly. I would say check with them and see how you could fix it to keep your name close to what you have without being the same as his....

well i actruallly got sued. I once had a company called Advance Carpet Cleaning Company and got sued by Advanced Maintanence Company over the name. They lost.
